This settlement was achieved on the eve of trial, after a protracted case where no offer had been made by the defendants. Because of the confidentiality agreement linked to the settlement the parties’ names may not be disclosed. This case involved a medical malpractice suit against a local hospital and two physicians who failed to diagnose and treat a necrotizing fasciitis which was treated simply as a yeast infection. Within forty-eight hours, the woman suffering from this condition died. The defense was that, even if had been picked up earlier, the appearance of symptoms made it impossible to save the patient’s life – any failure to diagnose would have no bearing on her survival.
