Norman Perlberger Wins Landmark Age-Discrimination Trial and Pomerantz Perlberger & Lewis are awarded counsel fees under Lodestar for their efforts.

Tomasso v. Boeing Company - As a result of post-trial motions to mold an earlier verdict of $636,278 to add pre-judgment interest, attorney's fees and costs, the federal court judge who presided over the jury trial, has now amended the judgment, which had already awarded back pay, front pay and punitive damages, to include these requested add-ons.

The jury verdict had arisen out of a suit brought by a former Boeing employee who charged the company with age discrimination when it laid him off as part of a reduction-in-force (RIF) at age 58 after 30 years with the company. Before trial, settlement negotiations had failed as Boeing suggested it could only put $50,000 on the case, believing it was a winning defense due to its alleged impartial evaluation process applied to improve the company's economic conditions. The jury found that Boeing had not only discriminated but that its practices were willful. Back pay was doubled as a result of this determination. A front pay award was also made.

Boeing filed for a motion for new trial and to reduce the verdict, but lost. PP&L filed its own supplemental motion asking for a lodestar counsel fee award and other monetary relief. The amended civil judgment entered on September 21, 2007, increased the jury verdict to the above molded judgment just missing the million dollar mark! Should Boeing now appeal this to the Third Circuit, interest will continue to run on the judgment until final determination and payment
