This page has been established to give our clients and others injured by Merck’s drug called “Fosamax”. It is particularly aimed at informing of the progress of existing litigation against Merck and new medical and scientific studies that point to a direct relationship between this drug and fractures of the femur (and hip).
First, it should be pointed out that there are already hundreds of cases, all consolidated in what is known as Multi-District Litigation (“MDL”), for discovery and pretrial purposes in the Southern District of New York, in which the lawyers at Pomerantz Perlberger & Lewis have participated. These cases involve claims that Fosamax caused osteonecrosis of the jaw. By our participation, we have acquired thousands of documents coming from discovery efforts of plaintiffs’ counsel through the MDL.

Originally, our cases were sucked into the MDL litigation which has lasted for several years and probably will continue bogged down while Merck delays and fights the jaw cases. Seeing that we were lost in that swamp of cases and that femur/hip fractures were not really what made up the hundreds of cases in the MDL, we filed a motion to have our oldest, lead case remanded (sent back) to the district court in New Jersey so that we could prosecute that suit more speedily and independent of the jaw cases. Thus, we have now placed our Fosamax femur fracture cases into their own venue, giving us the advantage of proceeding against Merck for our femur/hip fracture cases, without being lost in the quagmire of hundreds of jaw cases in the MDL. Television has now begun exposing the occurrence of femur fractures in women using Fosamax. Dr. Robert Bunning, a respected Washington DC physician, , after seeing the clear evidence of this rare fracture (where there had been no catastrophic trauma) in patients who had been taking Fosamax for over five years, gave an interview that was televised on local TV in North Carolina. On March 8, 2010, Diane Sawyer of ABC News reported this nationally.
Remember: There is a statute of limitations in each state that could prevent you from succeeding against Merck if you wait too long.
