Pending Cases
The firm is counsel in two pending class action suits venued in New Jersey and
Pennsylvania federal courts.
The first – Garlick v. Quest Diagnostics, et al. – is brought on behalf of physicians, pharmacists and nurses whose licenses have been suspended or threatened by reason of alleged substance abuse of alcohol. The suit against testing labs, third party administrators and medical review officers charges that the defendants fraudulent and/or negligently promoted, marketed, sold, distributed and reported on alleged positive EtG results that pointed to alcohol beverage consumption by the affected health care professionals. Scientific and governmental studies, including a recent official advisory, have confirmed that false positives are obtained through the incidental use of alcohol-containing products, such as hand sanitizers and mouthwash. The suit seeks to recover substantial monetary damages for the economic and non-economic losses suffered by the class plaintiffs. There are also individual suits brought by the firm that have been initiated for those plaintiffs who do not want to be part of the purported class in California, Oklahoma, Kansas & Pennsylvania.
The second class action suit – Williams v. Cyberonics, Inc. – is brought on behalf of patients who suffered economic and non-economic losses as a result of the surgical implantation into the vagus nerve of a device manufactured by Cyberonics, purportedly capable of alleviating treatment-resistant chronic depression. The suit alleges that the product simply does not work (allegedly a modern day “snake oil”) and that the victims have desperately and hopefully spent tens of thousands of dollars believing that this risky and permanently-installed device would bring them relief. The suit, founded upon causes of action for products liability, breach of warranty, consumer fraud and gross negligence, seeks redress for an estimated 2000 people (and, where applicable, their spouses) who have undergone this procedure.
Presently pending litigation, involving millions of dollars in individual claims in several state and federal courts, include medical malpractice, products liability, employment discrimination, wrongful termination, libel & slander, consumer fraud, premises liability, motor vehicle and other personal injury suits. In addition a number of matters involve the defense of business and real estate litigation cases where the firm represents companies that have been sued and have counter-sued for monetary and injunctive claims.
